In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliachak Police Station Case No. 280 of 2026 dated 26.02.2026 under Sections 21©/25/27A/29 of the NDPS Act, 1985.

In the matter of : Dildar Hossain
……Petitioner.
Mr. Mazhar Hossain Chowdhury
……for the Petitioner.
Mr. Sayak Chakraborti, Ld. Jr. Govt. Adv.
Mr. Arka Mukherjee
….for the State.
Learned advocate appearing for the petitioner submits that petitioner has been implicated on the basis of statement of co-accused. There has been no recovery from the present petitioner. Although the case involves alleged recovery of 515 Gms. of Brown Sugar.
State opposes the prayer for bail. From the Memo of Evidence submitted by the State I find there is a criminal antecedent of the present petitioner which is under the NDPS Act.

Having considered the same, I am of the opinion that this is not a fit case for anticipatory bail.
Accordingly, prayer for anticipatory bail in CRM (A) 3114 of 2026 is dismissed.
