In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliachak Police Station Case No. 128 of 2026 dated 25.01.2026 under Sections 21(c)/27A/29 of the NDPS Act, 1985.

... For the State.
Learned Advocate for the petitioner submits that from the possession of the present petitioner only 603 grams of brown sugar were recovered and there was no quantification in respect of the same. As such, the petitioner should be released on bail. Petitioner relied upon the orders passed in CRM (NDPS) 1598 of 2026 for claiming that the petitioner is entitled to be released on bail on the same principles. State has opposed the prayer for bail as there is 4.35 kgs of brown sugar as a whole which has been recovered in the present case. Petitioner was a part of the racket which was operating in the drug cartel for dealing with brown sugar, and there has been part recovery from the petitioner.
It has also been pointed out that petitioner has another case, being English Bazar P.S. Case No. 31 of 2026 dated 06.01.2026 against him under the provisions of NDPS Act apart from the present case. Having considered that there is more than one criminal case against the petitioner under the provisions of NDPS Act and there has been recovery from the possession of the present petitioner, I am of the opinion that the rigors of Section 37 of the NDPS Act are attracted. As such, prayer for bail of the petitioner is rejected. Consequently, CRM (NDPS)
of is dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent Photostat certified copy of this order/judgment, if applied for, be supplied to the parties upon compliance with all requisite formalities.
