01.10.2026 Item No.01 Court No.11 KCP WPST 187 of 2026

Dr. Sanjay Ghosh

- Versus - The State of West Bengal & Ors.

Mr. Goutam Pathak Banerjee Mr. Manujendra Narayan Roy Mr. Gourav Haldar

…for the petitioner

Ms. Chandreyi Alam, Ld. A.G.P. Ms. Soma Chakraborty

…for the State respondents

Mr. Roy, learned advocate appearing for the petitioner submits that alleging non-compliance of the order dated 16th March, 2017 passed by the learned Tribunal in the Original Application (in short, OA) being OA 1061 of 2016 the petitioner along with four other original applicants preferred a contempt application being CCP 82 of 2017. During pendency of such contempt application, the learned Tribunal stopped functioning and the writ petitioner became remediless. He, accordingly, filed the present writ petition being WPST 187 of 2026 on 25th September, 2026. Mr. Roy further submits that during pendency of the said contempt application, the other applicants in OA 1061 of 2016 withdrew the contempt application and accordingly, their names were expunged from the array of the applicants. In view of the change in the

2 circumstances, the petitioner herein also is no longer inclined to proceed with the said contempt application. However, as the learned Tribunal is not functioning, he cannot take necessary steps. As such, the writ petitioner prays for issuance of necessary direction to withdraw the contempt application. A letter for such withdrawal of the contempt application has also been submitted by the petitioner herein which stands annexed at page 36 of the writ petition. Such prayer has not been opposed by Ms. Alam, learned Additional Government Pleader appearing for the State respondents. In the said conspectus and as the petitioner herein is no longer inclined to proceed with the contempt application, the said contempt application is dismissed as withdrawn. With the above observations and directions, the writ petition is also disposed of. Office is directed to communicate this order to the Registry of the learned Tribunal to record such dismissal of the contempt application.
