In the matter of : Kakali Gupta Tah @ Kakali Gupta

… Petitioner(s)

Mr. Sujan Chakraborty Mr. Partha Sarkar

… for the petitioner(s)

Mr. Oooiseeroop Sinha Ms. Shalu Gupta

… for the State-respondent(s)

Learned advocate for the petitioner submits that the petitioner has been foisted with the criminal case due to change in administration. State opposes the prayer for anticipatory bail. I have taken into account the information which has been furnished and the facts of the case which emanates from July, 2023. Having considered the same, I am of the view that although the investigation may continue but custodial detention of the present petitioner is unwarranted.

Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Kakali Gupta Tah @ Kakali Gupta] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation is in progress, the petitioner shall meet with the I.O. of the case as and when she will be called upon by the I.O. for the sake of investigation. Additionally, the petitioner shall stay within the jurisdiction of Burdwan police station. If she intends to leave the jurisdiction of the said police station, she shall take permission from learned CJM, Purba Burdwan. Accordingly, CRM (A) 3070 of 2026 is disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
