In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Penro Police Station case no. 120 of 2021 dated 30.10.2021 under Sections 302/201/212/34 of the Indian Penal Code.

And In the matter of : Abdul Alim Molla @ Laltu

……Petitioner. Mr. Sk Toslim Ali

......for the Petitioner. Mr. Amarta Ghose Mr. Probal Das

……for the State.

Learned advocate appearing for the State has submitted a report that they intend to rely upon 6 witnesses which includes doctor and five police personnel. Petitioner is in custody for four years eight months. I have taken into account the deposition of the witnesses, a last opportunity as such, is granted to the prosecution. Having considered the long incarceration of the petitioner, I direct that if prosecution is unable to complete all the witnesses by 28th of February, 2027, in spite of cooperation rendered by the accused persons, the learned trial Court will release the petitioner on bail on such terms and conditions as the learned trial Court deems fit and proper. At this stage, prayer for bail of the petitioner is refused.

2 Learned trial Court is directed to strictly adhere to the directions made above taking into account the long incarceration already suffered by the petitioner. With the aforesaid observations, CRM (M) 1770 of 2026 is disposed of. Report and memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
