30.09.2026 Court No.35. D/L. 13. Kausik (Rejected)

CRM (M) 1980 of 2026

In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Baishnabnagar Police Station Case No. 74 of 2001 dated 26.07.2001 under Sections 302/34 of the Indian Penal Code.

And In the matter of : Wasaf Sk @ Wasaf Ali @ Wasef Ali @ Ashikul Sk.

……Petitioner.

Mr. Tapodip Gupta

……for the Petitioner.

Mr. Md. Wasim Akram

Ms. Sabrina Parveen

……for the Defacto Complainant.

Mr. Krishnendu Bhattacharya, Ld. APP

Ms. Tanusree Kar

……for the State.

Learned advocate appearing for the petitioner submits that petitioner is in custody for about 6 months. Charge sheet has been submitted. As such further detention of the petitioner is unwarranted.

State and the defacto complainant opposes the prayer for bail.

I find that the petitioner was absconding for 25 years and has been very recently arrested. Considering the fact of absconsion, I am not inclined to release the petitioner on bail.

2

As such, prayer for bail of the petitioner is rejected.

Accordingly, CRM (M) 1980 of 2026 is dismissed.

Memo of Evidence submitted be kept with the record.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
