30.09.2026 Court No.35. D/L. 14. Kausik (Allowed)

CRM (M) 1981 of 2026

In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bhagwangola Police Station Case No. 362 of 2024 dated 12.07.2024 under Sections 115(2)/117(2)/118(2)/109/103(1)/3(5) of the BNS, 2023.

And In the matter of : Abdul Basir @ Basir Sk. @ Basiruddin Sk.

……Petitioner.

Mr. Ranabir Roy Chowdhury

Mr. Mritunjoy Chatterjee

Mr. Debarnab Adhikary

……for the Petitioner.

Dr. Pradip Banerjee, APP

Ms. Casurina Chatterjee

……for the State.

Learned advocate appearing for the petitioner submits that petitioner is in custody for 2 years 2 months. Charge sheet was submitted. Charges framed and about 5 witnesses have been examined out of 28 witnesses proposed to be examined by prosecution in the charge sheet.

State opposes the prayer for bail and submits that it is this petitioner who inflicted the vital blow with iron rod upon the deceased which resulted in his death.

I have taken into account the statements of the State. Having considered that the incident stemmed out of an issue relating to installation of electric meter and after a scuffle, allegedly petitioner assaulted the deceased with iron rod, I am of the view that some issue relating to suddenness is involved in the present case. There are no criminal antecedents of the petitioner and the trial will take some time to be taken to its logical conclusion.

Without further entering into the merits of the case, on the aforesaid issues, I am inclined to release the petitioner on bail.

As such, petitioner, namely Abdul Basir @ Basir Sk. @ Basiruddin Sk. be enlarged on bail subject to furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned ACJM, Lalbagh.

If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Murshidabad without the prior permission of the learned Trial Court.

With the aforesaid observations, CRM (M) 1981 of 2026 is allowed.

Memo of Evidence submitted be kept with the record. The observations made above are only restricted for adjudication of the bail application and should not be considered a final opinion on the merits of the case.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
