CRM (M) 1977 of 2026

In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bakultala Police Station Case No. 473 of 2024 dated October 17, 2024 under Sections 103(1)/351(2)/61(2) of the BNS.

And In the matter of : Beauty Dhali @ Sekh

……Petitioner.

Mr. Navanil De

Mr. Srinjan Ghosh

……for the Petitioner.

Mr. Indradip Das

Mr. Soumalya Dutta

……for the State.

Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 10 months. Charge sheet has already been submitted on or about January, 2026. Emphasis has been laid on the fact that the FIR itself was registered almost after 2 months of the incident and there was an existing family dispute.

State opposes the prayer for bail and submits there are witnesses who substantiated the alleged offence. The facts of the case as is revealed from the case diary relate to a 4 year’s old child being allegedly thrown in a pond. There is a dispute in the family. The trappings of which are reflected from the statements of different witnesses. Petitioner is a relation who has been implicated as the prime accused.

However, I have taken into account the different issues involved in the case. Having regard to the fact that there was a dispute in the family and the information was furnished in a delayed manner and the petitioner being a lady, I am inclined to release the petitioner on bail.

As such prayer for bail of the petitioner is allowed.

As such, petitioner, namely Beauty Dhali @ Sekh be enlarged on bail subject to furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned ACJM, Baruipur.

If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of 24 Parganas South without the prior permission of the learned Trial Court.

Accordingly, CRM (M) 1977 of 2026 is allowed.

Memo of Evidence submitted be kept with the record. The observations made above are only restricted for adjudication of the bail application and should not be considered a final opinion on the merits of the case.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
