Sl.7 30.09.2026 Court No.6 BP

C.O. 3178 of 2026

Bikash Chandra Datta -versus- Ashok Dutta & Ors.

Mr. Tanmoy Chowdhury Ms. Ritoprita Ghosh … for the petitioner Mr. Debasis Kar Mr. Husen Mustafi Ms. Suhana Parvin ..for the opposite party no.1

Affidavit of service filed in Court today is taken on record. Seen the report of the Registrar (Judicial Service) dated 29th September, 2026. It appears from the said report that in spite of sincere effort the certified copies of the exhibited documents in connection with Title Suit No.109 of 2009 have been traced out but the original thereof have been not traced. The learned advocate appearing for the petitioner submits that the petitioner has filed an application before the learned trial judge on 16th February, 2026 praying for an order to proceed with the argument of the suit with the available documents and the certified copies of the exhibited documents. He further submits that no date has been fixed for hearing of such application. Heard learned advocate for the opposite parties.

2 The learned Civil Judge (Junior Division), 2nd Court, Barrackpore is requested to fix a date of hearing of the application dated 16th February, 2026 filed by the petitioner and dispose of the same in accordance with law and make an endeavour to dispose of the Title Suit No. 109 of 2009 as expeditiously as possible keeping in mind the direction for expeditious disposal passed by this Court on earlier occasion. With the above observations and directions, C.O. 3178 of 2026 stands disposed of. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
