In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Moyna Police Station case no. 266 of 2026 dated 25.07.20263 under Sections 126(2)/115(2)/117(2)/109/3(5) of the Bharatiya Nyaya Sanhita, 2023.

And In the matter of : Nanda Dolui @ Nondalal Dolai & Ors.

……Petitioners. Mr. S. K. Bhakat Mr. Mr. Chakraborty

......for the Petitioners. Mr. Rajendra Banerjee, Ld. APP Mr. Rajesh Kumar Shah Mr. Soumalya Dutta

……for the State.

Learned advocate appearing for the petitioners submit that there are case and counter cases. The police authorities in a overzealous manner pursued the case of the private opposite parties. There are no materials to suggest the complicity of the present petitioners. As such, they may be granted anticipatory bail. State has produced the Case Diary referred to the injury report and the statement of the injured. I have taken into account the same, having considered that petitioner nos. 2, and 4 are ladies, I am inclined to allow their prayer for anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner nos. 2, namely, Minati Dolai and 4, namely, Shrabani Dolai @ Sraboni Dolai is allowed.

2 So far as the petitioner no.1 and 3 are concerned, the prayer for anticipatory bail is rejected in view of their overt acts. As such, prayer for anticipatory bail of the petitioner no.1 namely, Nanda Dolai @ Nondalal Dolai and petitioner no.3 namely, Saikat Dolai @ Soikat Dolai @ Soikot Dolai is rejected. Accordingly, in the event of arrest, the petitioner nos. 2 and 4 shall be released on bail to the satisfaction of the Arresting Officer on such terms and conditions as he deems fit and proper subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioner nos. 2 and 4 shall make themselves available as and when required by the Investigating Officer of the case for the sake of investigation. Accordingly, CRM (A) 3032 of 2026 is partly allowed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
