Mr. Gaurab Kr. Das

…for the petitioner

This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Senior Division), 2nd Court at Barasat, to dispose of the Title Suit No. 1388 of 2023, expeditiously. The learned advocate appearing for the petitioner files a copy of the order dated 23rd July, 2026 whereby the application filed by the petitioner under Order 5 Rule 20 of the Code of Civil Procedure was allowed and the petitioner was directed to take necessary steps and file draft publication in a daily newspaper widely circulated in the locality in which the defendant no.2 is known to have last resided or carried on business or personally worked for gain. It is appears from the said order that 22nd December, 2026 is fixed for filing of the draft publication. Thus, it appears that the suit is not yet ready for hearing. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite parties. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned advocate for the petitioner, this civil revision application

stands disposed of by requesting the learned Civil Judge (Senior Division), 2nd Court at Barasat, to make an endeavour to dispose of the Title Suit no. 1388 of 2020 as expeditiously as possible after the same is ready for hearing. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
