Tripta Chakraborty Versus Samarendra Chakraborty & Ors.

[

This matter was mentioned by the learned Advocate for the petitioner citing urgency. Considering the urgency pleaded, this matter has been upgraded to be taken up today for hearing. However, none appears on behalf of the petitioner. This application under Article of the Constitution of India is at the instance of the defendant no.5 praying for a direction upon the learned Civil Judge (Senior Division), Serampore, Hooghly to dispose of the Title Suit No. 232 of 2024, expeditiously. From the order sheet appended to this application, this Court finds that an application for injunction is still pending. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. This civil revision application stands disposed of by requesting the learned Civil Judge (Senior Division), Serampore, Hooghly to dispose of the injunction application as expeditiously as possible without granting any unnecessary adjournment to either of the parties, provided the injunction application is otherwise ready for hearing.

After disposal of the said application, the learned trial judge shall make an endeavour to dispose of the Title Suit no. 232 of 2024 as expeditiously as possible without granting any unnecessary adjournment to either of the parties. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
