Mr. Shiv Prasad Ghosh

…for the petitioner

This application under Article of the Constitution of India is at the instance of the husband praying for a direction upon the learned Judge, Fast Track, 2nd Court, Barrackpore to dispose of the Matrimonial Suit No. 798 of 2023, expeditiously. From the order sheet appended to this application, this Court finds that an application under Section 36 of the Special Marriage Act 13th July, 2026 praying for alimony pendente lite at the instance of wife is pending. Mr. Ghosh, learned advocate appearing for the petitioner submits that the said application under Section 36 of the Special Marriage Act is at the evidence stage. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned advocate for the petitioner, this civil revision application stands disposed of by requesting the learned Judge, Fast Track, 2nd Court at Barrackpore to dispose of the application under Section 36 of the Special Marriage Act as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After disposal of the application for alimony pendente liate, the learned trial judge shall make an endeavour to dispose of the Matrimonial Suit no. 798 of 023 as expeditiously as possible provided the husband/petitioner is not in default in complying with the directions that may be passed in the application under Section 36 of the Special Marriage Act for payment of alimony pendente lite. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
