Sri Tapan Ghosh Vs. Sri Subrata Roy
Mr. Prantick Ghosh ….for the petitioner
This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Div.) at Sealdah to dispose of Money Suit No.1 of 2020 expeditiously. The learned advocate appearing for the petitioner submits that the application for amendment of plaint filed by the petitioner sometimes in the month of April, 2022 was allowed by an order dated June 27, 2024 and in spite of a liberty being granted to the defendant to file an additional written statement, the opposite party has not yet filed the additional written statement. From the order sheets appended to this application this Court finds that January 7, 2027 is fixed for hearing of the application under Order I rule 10 of the Code of Civil Procedure. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or the learned advocate representing the opposite party before the learned trial judge.

After disposal of the said application and any other interlocutory applications, that may be pending, the learned trial judge shall make an endeavour to dispose of the Money Suit No.1 of 2020 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.
