Mr. Dwaipayan Panda

……for the Petitioner.

Mr. Madan Mohan Roy

Mr. Rishav Kumar Thakur

….for the State.

Learned advocate appearing for the petitioner submits, due to property dispute petitioner has been foisted with a criminal case.

Learned advocate for the State opposes the prayer for anticipatory bail and draws the attention of the Court to the statement of the ladies/victims under Section 164 Cr.P.C.

I have taken into account the materials appearing and is of the opinion that custodial detention of the present

2 petitioner is not called for. However stringent conditions may be imposed. As such, I direct that in the event of arrest, the petitioner, namely, Bimal Chandra Das be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge sheet has already been submitted, this order of anticipatory bail will remain valid for a period of 6 weeks from date. Petitioner shall stay outside the jurisdiction of Balurghat Police Station till the same is modified by the learned Trial Court. With the aforesaid observations CRM (A) 3093 of 2026 is allowed. Memo of Evidence submitted be kept with the record.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
