Sl.42 29.09.2026 Court No.6 BP C.O. 3304 of 2026

Manoj Singh -versus- Bhupat Rai M. Gujjar

Mr. Samrat Choudhury Mr. Sayan Ray Mr. A. Sahani ..for the petitioner

This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Senior Division), 8th Court at Alipore to dispose of Title Suit No. 7 of 1995 expeditiously. The learned advocate appearing for the petitioner submits that the petitioner filed a suit for eviction on the grounds contained in Section 13 of the West Bengal Premises Tenancy Act, 1956. He submits that the application under Section 17(2) of the 1956 Act stood disposed of and a date was fixed for hearing of the application under Section 35 of the West Bengal Premises Tenancy Act and Order 39 Rule 7 of the Code of Civil Procedure. In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned Trial Judge. In the light of the submissions made by the learned advocate for the petitioner, C.O. 3304 of 2026 stands disposed of by requesting the learned Civil Judge (Senior Division), 8th Court at Alipore to make an endeavour to dispose of interlocutory application as expeditiously as possible but preferably within a period of four months from the next date fixed without granting any unnecessary adjournments to either of the parties. After disposal of the interlocutory application the learned trial judge shall make an endeavour to dispose of Title Suit No. 7 of 1995 as expeditiously as possible but preferably within a period of six months without granting any unnecessary adjournments to either of the parties. It is, however, made clear that the time limit for disposal of the interlocutory application and the suit has been fixed by this Court taking into consideration that the suit for eviction is pending from the year 1995 under the West Bengal Premises Tenancy Act, 1956. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
