Dinabandhu Ghosh & Ors. Vs. Nabin Mallick
Mr. Shyamal Roy
…for the petitioners
This application under Article 227 of the Constitution of India is at the instance of the defendants and is directed against an order dated March 19, 2026 passed by the learned Civil Judge (Sr. Division) 2nd Court (in-Charge), Paschim Medinipur in Title Suit no. 178 of 2026. By the order impugned an order of status quo was passed on an application under Order 39 Rules 1 and 2 of the Civil Procedure Code. An appeal lies against the order impugned under Order 43 Rule 1(r) of the Civil Procedure Code. For such reason this Court is not inclined to entertain this application. At this stage learned advocate appearing for the petitioners prays for leave to withdraw this civil revision application with liberty to approach the appropriate forum in accordance with law.
2 In the light of the submission made by the learned advocate appearing for the petitioners, this revisional application stands dismissed as withdrawn with liberty to the petitioners to approach the appropriate forum in accordance with law. Learned advocate-on-record of the petitioners shall be permitted to take back the certified copy of the order impugned by replacing the same with a photostat copy thereof.
