… Petitioner(s)

Ms. Minoti Gomes Mr. S. Ghosh

… for the Petitioner(s) Mr. Malay Dhar Mr. Suman Agarwal

… for the State-respondent(s)

Learned advocate for the petitioners submits that over a property dispute, the petitioners and the deceased had differences which resulted in scuffle and, subsequently, the deceased succumbed to the injuries. The petitioners are in custody for more than eight months; charge-sheet has already been submitted and the case has already been committed to the court of Sessions. State opposes the prayer for bail and emphasizes on the pre-plan nature of injury being inflicted upon the deceased. The attention of the court has been drawn to the post-mortem report which speaks injuries being inflicted upon the deceased.

I have taken into account the materials appearing in the case diary and having regard to the overall circumstances, I am of the view that the prayer bail of the petitioner no.1 [Krishna Prasad Mondal] be Rejected. So far as the bail prayer of the petitioner no.2 is concerned, her bail prayer is allowed. Hence, the prayer for bail of the petitioner no.2 is Allowed. Accordingly, the petitioner no.2 viz, [Jyotsna Mondal] shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned CJM, Paschim Medinipur. If on bail, the petitioner shall also make herself physically available on each and every date so fixed by the learned trial court and shall not leave the district of Paschim Medinipur without prior permission of the learned trial court. Accordingly, CRM (M) 1884 of 2026 is Partly allowed. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
