1. The petitioner is studying in class XII. He prays for a direction upon the respondent authorities particularly the school to permit him to appear in the third semester examination on the subject ‘Environmental Science’.

2. It appears from the submissions made on behalf of all the parties that the petitioner did not pursue Environmental Science subject in semesters one and two. All on a sudden, the petitioner’s prayer for appearing in Environmental Science subject in semester three does not appear to be proper. The same cannot be allowed.

3. The petitioner has not attended any class in Environmental Science. The school does not have the Environmental Science subject in respect of any of the students of the petitioner’s batch.

4. It is elementary that a candidate without appearing in semesters I and II in a subject cannot be permitted to appear in semester III.

5. In view of the aforesaid facts and circumstances, the prayer of the petitioner to appear in Environmental Science examination in semester three cannot be allowed.

6. The writ petition fails and is hereby dismissed.

7. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

8. Certified server copy of this order, if applied for, be supplied to the parties on compliance of all requisite formalities.
