D/L- 20 28/09/2026 Ct. No.- 6 Aritra C.O. 3240 of 2026

Abdul Hamid & Ors. Vs. Ansar ali & Ors.

Mr. Pradip Paul Mr. Gourab Ghosh ….for the petitioners

This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Div.) at Chanchal, District-Malda to dispose of Partition Suit No.368 of 2022 and the Misc. Case No.11 of 2025 expeditiously. The learned advocate appearing for the petitioners submits that the Misc. Case No.11 of 2025 has been filed by the petitioners alleging violation of the order of injunction. From the order sheets appended to this application this Court finds that the partition suit as well as miscellaneous case are not yet ready for hearing and November 27, 2026 has been fixed for service returns in the suit as well as in the miscellaneous case. For such reason this Court is not inclined to pass any direction for expeditious hearing at this stage as neither the suit nor the miscellaneous case are not ready for hearing. CO 3240 of 2026 stands disposed of with an observation that after the suit and the miscellaneous case are made ready for hearing an endeavour should be made
