In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with ST No. 3(II) 2023/SC No. 83 of 2021 arising out of Chakdah PS Cse No. 17 of 2021 dated 11th January, 2021 u/s 302/120(B)/201 of the IPC.

In the matter of : Param @ Paran Das

… Petitioner(s)

Mr. Shibaji Kr. Das Ms. Deblina De

… for the Petitioner(s) Mr. Rishav Kumar Thakur

… for the State-respondent(s)

State opposes the prayer for bail tooth and nail. However, from the records, I find that on 11.02.2026 when the bail of the present petitioner was rejected in CRM (M) 2484 of 2025, there were directions to complete the prosecution witnesses within a period of four months. The present bail application is being considered after seven months. State is advancing the same prayer as was advanced on 11.02.2026 that out of the 19 witnesses, 15 witnesses have been examined. Having considered that from February, 2026, there has been no progress in the case, I am inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Param @ Paran Das shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the ACJM, Kalyani, Nadia. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the district of Nadia without prior permission of the learned trial court. Additionally, the petitioner shall meet with the Inspector-in-charge of the Chakdah Police Station once in a week till the evidence of the prosecution witnesses is completed and submit his acknowledgement regarding his attendance before the learned trial court on the next date fixed. Accordingly, CRM (M) 1874 of 2026 is allowed. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
