28.09.2026 Serial no. 52 [G.S.Das] Assistant Registrar (Court)

CRM (M) 1949 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Hariharpara PS Cse No. 98 of 2026 dated 18.02.2026 u/s 103(1)/238 of the BNS.

In the matter of : Ahad Sk.

… Petitioner(s)

Mr. Tapodip Gupta Ms. Usshi Chattopadhyay

… for the Petitioner(s)

Mr. Pinaki Bhattacharyya, Sr. Govt. Adv. Mr. Amartya Mohan Bhattacharyya

… for the State-respondent(s)

Petitioner submits that the petitioner is in custody for more than seven months and the case is based on circumstantial evidence. There is nothing to connect the petitioner who is aged about 60 years and has been foisted with the present criminal case. State opposes the prayer for bail and draws the attention of the court to the postmortem report. I have taken into account the same along with the available evidence which speaks last seen theory. Prima facie, from the postmortem report, it appears that the deceased was sexually assaulted, thereafter, smothered and manually strangulation to death.

2 Having considered the heinousness of the offence, I am of the opinion that this is not a fit case for granting bail to the present petitioner. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (M) 1949 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
