CRM (M) 1957 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Bijoyganj Bazar PS Case No. 64 of 2025 dated 11.07.2025 u/s 103(1)./3(5)/61(2) of the BNS

In the matter of : Mohibul Islam

… Petitioner(s)

Mr. Joy Chakrbaorty Mr. Sandip Dinda

… for the Petitioner(s)

Mr. Priyankar Ganguly Ms. Shalini Bairagi

… for the State-respondent(s)

Petitioner submits that the petitioner is in custody for eight months; charge-sheet has been submitted and five other accused persons have been granted bail by the learned Sessions Judge. Therefore, learned advocate prays that the petitioner may be released on bail. State produces the case diary and refers to the statement under section 183 of the BNSS as well as the postmortem report. The report reflects that death of the deceased was due to gunshot and the complicity of the petitioner is that he was in the conspiracy as is reflected from the statement under section 183 of the BNSS.

2 I do not find any reason for the bail being granted by the learned Sessions Judge which has been submitted and the same is subject to challenge for cancellation of bail. Having considered the role of the petitioner and the gravity of the offence, I am not inclined to release him on bail. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (M) 1957 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
