In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Duttapukur Police Station case no.

of dated 03.11.2024 under Sections 126(2)/117(2)/109/103(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023.

And In the matter of : Sabir Ali @ Sabir Hossain @ Md. Sabir Hossain @ Md. Sabir Ali

……Petitioner. Mr. Deepak Prahladka Mr. Pompey Bose Ms. Reshmi Khatun

.....for the Petitioner. Mr. Pritam Roy Mr. Kaustav Manna

……for the State.

Learned advocate appearing for the petitioner submits that in spite of earlier direction passed in CRM (M) 1958 of 2025 and for the last ten months there has been no progress in the case. Petitioner is in custody for more than one year ten months. Learned advocate appearing for the State opposes the prayer for bail. Records reflect that case has not been committed to the Court of Sessions till date. I have taken into account the genesis of the dispute which is relating to refund of Rs.25,000/-. Report of the State reflects that there are no criminal antecedents of the present petitioner. Having considered the foundation of the criminal case and there are no antecedents as also the period of detention, I am of the opinion that without further going into the merits of the case petitioner be released on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner, namely, Sabir Ali @ Sabir Hossain @ Md. Sabir Hossain @ Md. Sabir Ali shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Barasat, North 24 Parganas. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of North 24 Parganas without prior permission of the learned Trial Court. Thus, CRM (M) No. 1894 of 2026 is allowed. Memo of evidence and status report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
