In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Tarakeshwar Police Station Case No. 61 of 2023 dated 15.02.2023 under Sections 420/406/409 of the Indian Penal Code.

……Petitioner.

Mr. Sanat Kr. Das

Mr. Sujon Chtterjee

Mr. Rohan Bavishi

……for the Petitioner.

Mr. Gouranga Kumar Das, Ld. APP

Mr. Mukesh Gupta

….for the State.

Mr. Aniket Mitra

….for the WBSEDCL

Petitioner is a professional chartered accountant. He has been accused of using the portal of WBSEDCL for Income Tax purposes.

Learned advocate appearing for the WBSEDCL submits that authorities have not suffered any wrongful loss. It is only without the knowledge and consent the portal has been used for the benefit of the petitioner.

State opposes the prayer for anticipatory bail.

2

Having considered the plea taken up by the WBSEDCL, I am of the opinion custodial detention of the present petitioner is unwarranted.

As such prayer for anticipatory bail is allowed. As such, I direct that in the event of arrest, the petitioner, namely, Shyamal Kundu be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge sheet has already been submitted this order of anticipatory bail will be valid for a period of 6 weeks. Accordingly, CRM (A) 751 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
