CRM (A) 2976 of 2026

In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Nalhati Police Station case no. 335 of 2026 dated 02.07.2026 under Sections 320(4)/115(2)/117(2)/79/118(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023.

And In the matter of : Ajay Mal & Ors.

……Petitioners. Mr. Mahaboob Ahmed Ms. Ananya Das

......for the Petitioners. Mr. Shankar Mukherjee

……for the State.

Learned advocate appearing for the petitioners submits that petitioners have been foisted with a criminal case because of neighbouring disputes. The injuries complained of has been exaggerated and the petitioners are forced to be taken to custody. Learned advocate appearing for the State opposes the prayer for anticipatory bail. I have taken into account the materials appearing in the Case Diary. Having considered the overall materials appearing, I am of the opinion that on stringent conditions the prayer for anticipatory bail of the petitioners namely, (1) Ajay Mal; (2) Sukumar Mal; (3) Debnarayan Mal; (4) Sudip Mal and (5) Nabadwip Mal is allowed. Accordingly, in the event of arrest, the petitioners shall be released on bail to the satisfaction of the Arresting Officer on such terms and conditions as he deems fit and proper subject to the conditions as laid down under Section 438(2) of the Code of Criminal

2 Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Additionally, petitioners shall stay outside the jurisdiction of Nalhati Police Station till modified by the learned Additional Chief Judicial Magistrate, Rampurhat. Petitioners shall once in a week meet with the investigating officer of the case and for the said purposes they will enter the jurisdiction of Nalhati Police Station. Accordingly, CRM (A) 2976 of 2026 is allowed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
