1. Learned advocate appearing for the petitioner submits that the petitioner has been falsely foisted with the criminal case over a trivial matrimonial dispute.

2. Learned advocate appearing for the State opposes the prayer for bail. He draws the attention of this Court to the injury report.

3. Injury report reflects that there is a swelling over the right eye which was due to the assault inflicted by the husband and it has been submitted that earlier, there are four criminal cases against the present petitioner. I find that there is a charge-sheet having already been filed in the year 2022 which are under Sections

2 498A/323/506 of the IPC. Subsequently, in another case where charge-sheet was submitted under Section 406 of the IPC.

4. It has been submitted on behalf of the State that this is the second marriage of the present petitioner.

5. Be that as it may, having regard to the fact that there are other two cases also and considering that the petitioner did not amend himself in spite of earlier criminal cases and has assaulted his wife, I am of the opinion that the prayer for anticipatory bail cannot be acceded to.

6. Accordingly, the prayer for anticipatory bail of the petitioner, namely, Raju Das is rejected.

7. With the aforesaid observation, C.R.M. (A) 3027 of 2026 is dismissed.

8. Memo of evidence submitted be kept with the record.

9. All parties shall act in terms of the server copy of the order downloaded from the official website of this Court.

10. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
