1. MAT 1662 of 2026 arises out of an order dated September 24, 2026 passed by a learned single Judge of this Court in refusing to extend the interim order which had been passed by another learned Judge in the Vacation Bench.

2. Mr. Majumder, learned senior advocate submits that the interim order should be extended upto August 2026. The interest part was being paid regularly till August 2026.

3. Learned advocate for the Bank submits that the account has not yet been declared NPA and if the interest component is paid every month, then the bank will not object to the extension of the interim order to the extent that the bank will not take any coercive action against the appellants.

4. Having heard Mr. Majumder, learned senior advocate for the appellants and Mr. Jha, learned advocate for the bank, we direct that subject to payment of the interest component for each month by the appellant, the Bank shall not take any coercive action in respect of the loan for a period of three months or until further orders by the writ court, whichever is earlier. In case of failure to comply with our order, the Bank can proceed according to law.

5. We direct the learned single Judge to de-tag W.P.A. 22673 of 2026 from W.P.A. 12205 of 2026 with the connected application and list the matters separately and hear them out separately.

6. Accordingly, the appeal and the connected application are disposed of.

7. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
