CRM (M) 1958 of 2026

In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Bharatpur Police Station case no. 220 of 2025 dated 15.07.2025 under Sections 103/61(2)/238 of the Bharatiya Nyaya Sanhita, 2023.

And In the matter of : Rupa Bibi & Anr.

……Petitioners. Mr. Kallol Kumar Basu Mr. Jannat Ul Firdous Mr. Rajsekhar Hota

.....for the Petitioners. Mr. Subhashis Pachaal Ms. Nupur Chaudhuri

……for the State.

Learned advocate appearing for the petitioners submit that petitioners are in custody for one year two months and till date only 10 witnesses have been examined out of the 30 witnesses cited by the prosecution. The cited witnesses have supported the prosecution case. Petitioners as such may be released on bail. Learned advocate appearing for the State has produced the Case Diary including the statement of two of the witnesses under Section 183 of the BNSS. I have taken into account the same along with the evidence of the child witnesses which has been enclosed along with the application. Having considered the totality of the circumstances reflecting, I am of the opinion that prayer for bail of the petitioners is rejected at this stage.

2 Prosecution is granted six months time to complete the rest of the witnesses. If in spite of the cooperation rendered by the accused persons the prosecution is unable to complete its witnesses, the trial Court would release the petitioners on such terms and conditions as he deems fit a proper. With the aforesaid observations, CRM (M) 1958 of 2026 is disposed of. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
