Mr. Tanmay Chattopadhyay Mr. Joy Laha …. For the Petitioners Mr. Arka Bhattacharya Mr. Banshi Badan Maity …. For the State

CAN 1 of 2026 is not in the file. Copy of the application produced by the applicants is treated as the original application and taken on record. On prayer of the applicants liberty is granted to withdraw the application. CAN 1 of 2026 is accordingly dismissed as withdrawn. Learned counsel for the State produces copies of the documents which demonstrate that the Prescribed Authority and the Block Development Officer, Ratua II issued a letter to the Additional District Magistrate (Panchayat), Malda on 17th September, 2026 seeking permission for extension of the time limit for election of the Upa Pradhan of the Panchayat. The application is still pending. In view of the above, the Prescribed Authority is directed to convene the meeting upon receipt of concurrence from the relevant authority, in accordance with law.
