(Mahidul Haque Sardar & Ors. vs. State of West Bengal & Ors.)

Mr. Pawan Kr. Gupta Syed Julfikar Ali Mr. Sankha Subhra Chakey …. For the Petitioners Ms. Tapasi Palit Sinha Mr. Suman Chattopadhyay …. For the State

Affidavit of service filed by the petitioners is taken on record. Learned counsel for the petitioners submits that the petitioners are members of Uttar Kusum Gram Panchayat and seeks a direction upon the police authority to render necessary assistance to the Prescribed Authority so that the meeting fixed for election of the new Pradhan of the Panchayat on 30th September, 2026 can be held without any hindrance. Learned counsel for the State submits that the police authority is prepared to render such assistance to the Prescribed Authority. In view of the above, the Officer in Charge, Usthi Police Station, being the 8th respondent herein, is directed to render necessary assistance to the Prescribed Authority so that the meeting is held peacefully without any disturbance from any corner whatsoever. The police authority shall ensure safe passage of the members of the Panchayat to the venue of meeting in order to enable them to cast their votes freely, safely and independently. The writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
