This application under Article of the Constitution of India is at the instance of the plaintiffs praying for a direction upon the learned Civil Judge (Junior Division), 2nd Court at Malda to dispose of the injunction application filed in Title Suit No. 175 of 2026 expeditiously. The learned advocate appearing for the petitioners submits that the next date fixed for hearing of such application is 19th November, 2026. The learned advocate appearing for the opposite parties submits that the court is presently lying vacant. In the light of the submissions made by the learned advocates for the respective parties, C.O. 3148 of 2026 stands disposed of by observing that after the Presiding Officer joins the learned Civil Judge (Junior Division), 2nd Court at Malda shall take up the hearing of the injunction application, if the same is otherwise ready for hearing, and make an endeavour to dispose of the same as
expeditiously as possible without granting any unnecessary adjournments to either of the parties. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
