(Ajij Mondal & Ors. vs. State of West Bengal & Ors.)

Mr. Oishik Chatterjee Amanul Islam Mr. Saurav Mukherjee Mr. Gourav Roy …. For the Petitioners Mr. Arka Bhattacharya Mr. Sudipto Maiti …. For the State

Affidavit of service filed by the petitioners is taken on record. Learned counsel for the petitioners submits that the petitioners are members of Hatkhola Gram Panchayat and seeks a direction upon the police authority to render necessary assistance to the Prescribed Authority so that the meeting fixed for election of the Pradhan of the Panchayat on 29th September, 2026 can be held without any hindrance. Learned counsel for the State submits that the police authority is prepared to render such assistance to the Prescribed Authority. In view of the above, the Inspector in Charge, Chapra Police Station, being the 7th respondent herein, is directed to render necessary assistance to the Prescribed Authority so that the meeting is held peacefully without any disturbance from any corner whatsoever. The police authority shall ensure safe passage of the members of the Panchayat to the venue of meeting in order to enable them to cast their votes freely, safely and independently. The writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
