25.09.2026 Serial no. 4 [G.S.Das] Assistant Registrar (Court)

CRM (M) 2387 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Duttapukur PS Case No. 627 of 2022 dated 27.06.2022 u/s 302/34 of the IPC and sections 25/27 of the Arms Act.

… Petitioner(s)

Mr. A. Chakraborty Mr. S. S. Saha

… for the Petitioner(s)

Mr. Aditya Tiwari Ms. Namrata Chatterjee

… for the State-respondent(s) Dr. Achin Jana Mr. Prosenjit Ghosh Ms. C. Rustagi

… for the defacto-complainant

Learned advocate for the petitioner submits that the petitioner is in custody for more than four years three months and till date, the prosecution, even if after repeated directions, could not complete the evidence of the three witnesses. Learned advocate for the State submits that presently the cross-examination of the first investigation officer is in progress and the second investigating officer is only left to be examined.

Having considered the final stage of the case, I am of the opinion that as a last chance an opportunity be granted to the prosecution. Let the evidence of the prosecution witnesses specifically the examination-in-chief of the second investigating officer be completed by 31st January, 2027. Having considered the stage of the case, at this stage, I am not inclined to grant bail to the present petitioner. Hence, the prayer for bail of the petitioner is Rejected. The learned trial court would adhere to the schedule and will not allow any of the parties to delay the evidence and/or further proceedings of the trial. Accordingly, CRM (M) 2387 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Report submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
