… for the petitioner(s)

Mr. Kallol Mondal, ld. PP Mr. Aditya Tiwari Ms. Namrata Chatterjee

… for the State-respondent(s)

Learned advocate for the petitioners submits that the petitioners are the bothers-in-law and have been implicated in the instant case as the deceased [the wife of their brother] expired within one year of solemnization of the marriage. I have taken into account the statement under section 183 of the BNSS as also the postmortem report. Having regard to the overall circumstances of the case and the accusations being against the other accused persons and not specific against these petitioners as also the factum that charge-sheet has already been submitted, I am inclined to grant anticipatory bail to the present petitioners. Hence, the prayer for anticipatory bail of the petitioners is Allowed. Accordingly, I direct that in the event of arrest, the petitioners [Tapas Bag and Sunil Bag] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge-sheet has already been submitted, this order of anticipatory bail will remain valid for a period of six weeks from date. Accordingly, CRM (A) 3154 of 2026 is disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
