In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Kumarganj PS Cse No. 442 of 2025 dated 19.12.2025 u/s 21(c)/22(c)/23(c)/25/27A/28/29 of the NDPSAct.

In the matter of : Saleman Ali Mandal @ Saleman Mandal

… Petitioner(s)

Mr. Sekhar Kumar Basu, Sr Adv. Mr. Kaushik Choudhury Mr. Dwaipayan Panda

… for the Petitioner(s)

Mr. Ayan Basu Mr. Gautam Banerjee

… for the State-respondent(s)

Learned Senior advocate appearing for the petitioner submits that there was alleged recovery of 22 cartoons containing 2640 pieces of Wincerex Cough syrup from a vehicle. The petitioner’s name subsequently transpired in course of the investigation and he is in custody since 3rd February, 2026. There are no materials to suggest the complicity of the present petitioner and the recovery was from different set of persons, as such, the petitioner be released on bail. Learned advocate for the State opposes the prayer for bail and refers to the statement of the witnesses who do substantiate the complicity of the present petitioner in respect of the ownership of the goods.

Having considered the quantum of seizure and the complicity which is appearing in the papers collected by the investigating agency, I am of the opinion that this is not a fit case for grating bail to the present petitioner as the rigors of Section 37 of the NDPS Act are attracted. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (NDPS)

of is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
