In the matter of : Sk Anawar Ali @ Mithu &Anr.
… Petitioner(s)
Mr. BIswajit Manna
… for the petitioner(s)
Mr. Priyankar Ganguly Ms. Shalini Bairagi
… for the State-respondent(s)
Learned advocate appearing for the petitioners submits that the petitioners have been foisted with the criminal case because of the act and actions of their son, they are innocent and have been falsely implicated in connection with the instant case. Learned advocate emphasizes that the victim has been changing her version continuously. State produces the case diary. I have taken into account the statement of the victim under section 183 of the BNSS as also the complicity of both the petitioners.
Having considered the same, I am of the opinion that this is not a fit case for granting anticipatory bail to the present petitioners. Hence, the prayer for anticipatory bail of the petitioner is Rejected. Accordingly, CRM (A) 2656 of 2026 is dismissed. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
