In the matter of : Kamal Nadab

… … Petitioner(s)

… for the Petitioner(s)

Mr. Ayan Basu Mr. Gautam Banerjee

… for the State-respondent(s)

Learned advocate for the petitioner submits that there were two seizures being 579 gm and 602 gm of brown sugar from other accused persons. So far as the present petitioner is concerned, he has been implicated only on the basis of statement of a co-accused. According to the learned advocate, there are no other materials appearing against the present petitioner, as such, the petitioner may be released on bail. State opposes the prayer for bail but on a specific query from this court, learned advocate for the State submits that there are neither any criminal antecedents nor any CDR and/or money trail appearing against the present petitioner as is reflected from the Memo of evidence.

Having regard to the materials available and the fact that the petitioner has been implicated only on the basis of statement of a co-accused, I am inclined to grant bail to the present petitioner. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Kamal Nadab shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court (NDPS Act), 4th Court, Malda. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Malda without prior permission of the learned Special court/trial court. Accordingly, CRM (NDPS) 1997 of 2026 is allowed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
