22.09.2026 Serial no. 450 [G.S.Das] Assistant Registrar (Court)

CRM (NDPS) 2011 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Tapan PS case no. 570 of 2024 dated 31.12.2024 u/s 21(c)/22(c)/23(c)/27A of the NDPS Act read with section 14A(b) of the Foreigners Act.

-And-

In the matter of : Md. Mahijuddin

… Petitioner(s)

Mr. Kaushik Choudhury Mr. Dwaipayan Panda Mr. Tridib Das

… for the Petitioner(s)

Mr. Ayan Basu Mr. Gutam Banerjee

… for the State-respondent(s)

Learned advocate for the petitioner submits that the petitioner is in custody since 31.12.2024 and the subject- matter of the case relates to alleged recovery of 100 bottles of Fairdyl cough syrup. State opposes the prayer for bail and submits that the petitioner happens to be a foreigner and not an Indian national who was involved in such clandestine dealing of cough syrup. Having regard to the fact that the rigors of section 37 of the NDPS Act are attracted, I am not inclined to grant bail to the petitioner at this stage.

Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (NDPS)

of is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
