……Petitioner.

Mr. Deepak Prahladka

Ms. Reshmi Khatun

……for the Petitioner.

Mr. Rajashree Venket Kundalia, Ld. APP

Mr. Suparna Biswas Majumder

….for the State.

Learned advocate for the State has produced the report of the forensic laboratory relating to the material retrieved by them and the opinion which has been expressed. Petitioner is in custody for 3 years 10 months and records reflect that out of 9 witnesses cited by the prosecution, 2 witnesses have been examined till date.

Having considered the possibility of the trial to be taken to its logical conclusion very soon is remote, I am of the opinion that petitioner be released on bail on stringent condition on grounds of long incarceration.

Accordingly, prayer for bail of the petitioner is allowed.

2

If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of South 24 Parganas without the prior permission of the learned Special Court. Accordingly, CRM (M) 2105 of 2026 is allowed.
