Dr. Surojit Ghosh vs. The State of West Bengal and others

Mr. Sankha Ghosh Mr. Manujendra Narayan Roy Mr. Gourav Halder …for the petitioner

Ms. Chandreyi Alam Ms. Runu Mukherjee …for the State

Mr. Ghosh, learned advocate appearing for the petitioner submits that due to non-functioning of the Tribunal, the petitioner is unable to avail his remedy before the learned Tribunal. He further submits in such circumstances he is rendered remediless and he prays for necessary direction, so that he can avail remedy before the learned Single Bench of this Hon’ble Court. For enabling the petitioner to avail a remedy before the learned Single Judge, we dispose of the original application being O.A. No. 119 of 2026 since it is submitted by the learned advocate for the writ petitioner that for want of a functional Tribunal, he is not even in a position to withdraw the pending original application. In view thereof, we dispose of the present writ petition being WPST No. 181 of 2026 by granting liberty

2 to the petitioner to avail the remedy before the Hon’ble Single Bench of this Court. A copy of this order be communicated to the learned Register of the West Bengal Administrative Tribunal to record the disposal of the OA.
