22.09.2026 Court No.35. D/L.24. Rakib (Rejected)

CRM (A) 3013 of 2026

In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Joypur Police Station case no. 40 of 2026 dated 12.05.2026 under Sections and under Sections 310(2)/317(3) of the Bharatiya Nyaya Sanhita, 2023.

And In the matter of : Ijhar Chowdhury & Anr.

……Petitioners. Mr. Pawan Kumar Gupta Mr. Sougata Mitra Mr. Nikhil Gupta Ms. Soma Chakraborty Mr. Subhradeep Mitra Ms. Sofia Nesar

.....for the Petitioners. Mr. Debajyoti Deb Ms. Kritika Jain

……for the State.

Learned advocate appearing for the petitioners submit that petitioners have been falsely implicated in connection with the instant case. Similarly placed accused person has been granted anticipatory bail by the learned Sessions Court. Learned advocate appearing for the State has drawn the attention of the Court to the fact that there are previous antecedents of both the petitioners. Memo of evidence submitted by the State reflects that the petitioners were earlier involved in similar type of offences since the year 2015 and 2018. Having considered the antecedents of the petitioners, I am not inclined to extend the benefit of anticipatory bail.

2 Accordingly, prayer for anticipatory bail of the petitioners in CRM (A) 3013 of 2026 is dismissed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
