CRM (M) 2132 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Swarupnagar PS Case No. 193 of 2026 dated 03.05.2026 u/s 20(1) and 21 of the Immigration and Foreigners Act, 2025 and section 12 of the Passport Act.

In the matter of : Bimol Pal @ Bijay Pal

… Petitioner(s)

Mr. Uday Sankar Chattopadhyay Ms. Sadia Parveen

… for the Petitioner(s)

Mr. Amarta Ghose Mr. Probal Das

… for the State-respondent(s)

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 140 days and the petitioner entered India in the year 2022. The petitioner claims benefits to the Notification issued by the Ministry of Home Affairs. A reference has been made to the Immigration and Foreigners (Exemption) Order, 2025. I have taken into account the same. The petitioner do not disown to be a national of another country but submits that subsequently by virtue of the Notification he has been compelled to enter India. Be that as it may, the petitioner has relied upon certain documents. However, such documents be first

2 considered by the learned Magistrate. To that effect, the Investigating Officer will conduct an enquiry and submit a report before the learned Magistrate within a period of 45 days. The learned Magistrate would assess the veracity of the report, thereafter, pass orders in an application for bail, if any, in accordance with law. Having considered the overall circumstances, at this stage, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (M) 2132 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
