In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Hili Police Station Case No. 208 of 2025 dated 12.10.2025 under sections 21(c)/22(c)/23(c)/27A/28 of NDPS Act.
And In the matter of : Ayubuddin Mondal @ Ayub Mondal @ Ayubddin Mondal
……Petitioner.
Mr. Kaushik Choudhury
Ms. Busra Khatun
……for the Petitioner.
Mr. Kallol Mondal, Ld. PP Mr. Anamitra Banerjee Mr. Sreyash Kumar Singh
……for the State.
Records of the case reflect that on earlier occasions State advanced submissions that there were Call Detail Records and money transactions available between the present petitioner and the principal accused. On a consideration of same on 17.06.2026, the bail application of the petitioner was rejected by this Court.
Today learned advocate for the State submits that so far as the case diary is concerned, CDR and money transactions are not available in the case diary. However, since there is no change of circumstances since the order of bail was rejected on an earlier occasion and the bail application was filed within a
2 period of 2 months, at this stage, I am not inclined to release the petitioner on bail.
Accordingly, CRM (NDPS) 1951 of 2026 is dismissed.
Memo of Evidence submitted be kept with the record.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
