CRM (NDPS) 1948 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Gazole PS Case No. 1147 of 2025 dated 18.12.2025 u/s 21(c)/25/27 and 29 of the NDPS Act..

In the matter of : Md. Sahin Sk

… Petitioner(s)

Mr. Manjeet Saha

… for the Petitioner(s)

Mr. Ayan Basu Mr. Gautam Banerjee

… for the State-respondent(s)

The petitioner was arrested on 18th December, 2025 and is unnecessarily detained in custody. Learned advocate for the State opposes the prayer for bail and submits that the recovery in the present case is 1.416 kg of brown sugar. Having considered the huge quantity of contraband being recovered, I am not inclined to grant bail to the present petitioner as the rigors of Section 37 of the NDPS are attracted. Hence, the prayer for bail of the petitioner is Rejected. The trial court is directed to expedite the proceedings.

Accordingly, CRM (NDPS)

of is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
