CRM (NDPS) 1901 of 2026

In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with NDPS Cse no. 11 of 2024 being NCB crime no. 08 of 2024 dated 23.04.2024 u/s 8(c)/22/23/29/35 and 54 of the NDPS Act.

In the matter of : Jhilam Khanna

… Petitioner(s)

Mr. Raja Mukherjee

… for the Petitioner(s)

Mr. Gouranga Kr. Das Mr. Priyankar Ganguly

… for the Union of India

Learned advocate for the petitioner submits that the petitioner was arrested on 23.04.2024 and since then he is in custody. Although, charge-sheet has been submitted but till date only three witnesses have been examined out of the 11 witnesses cited by the prosecution. There is no possibility of the trial being concluded in near future, as such, learned advocate prays that the petitioner may be released on bail, as the initial claim of the prosecution relates to the contraband being challenged after the forensic report reached the court. State opposes the prayer for bail and submits that there is another case against the present petitioner. The quantum of seizure is of commercial quantity.

I have taken into account the modus operandi of the present case and the antecedent of the present petitioner. Having regard to the same, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is Rejected. The learned trial court would pre-pone the examination of the independent witnesses. The petitioner would renew his prayer for bail after the evidence of the independent witnesses is over. Accordingly, CRM (NDPS)

of is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
