In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Jagaddal Police Station Case No. 323 of 2023 dated 10.08.2023 under Sections 366A/370/370A/372/373/120B of the Indian Penal Code read with Section 6/17/21 of the POCSO Act and under Section 3/4/5/6/7 of the Immoral Traffic (Prevention) Act.
And In the matter of : Biswajit Roy
……Petitioner.
Ms. Kausiki Bose
….for the Petitioner.
Mr. Priyankar Ganguly
Ms. Shalini Bairagi
….for the State.
Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 2 years and 11 months. 6 witnesses till date has been examined out of 28 witnesses. Two of the accused persons have been granted bail. Petitioner as such prays for bail.
Learned advocate for the State has produced the case diary, drawn the attention of the Court to the statement of one of the victim under Section 164 Cr.P.C.
I have taken into account the complicity of the present petitioner who was thickly involved in the offence of sexual
2 exploitation. The charges for which the petitioner is facing trial and its prescribed punishment are having severe consequences.
Having regard to the same, I am of the opinion that this is not a fit case for granting bail.
Learned Trial Court is directed to expedite the trial.
Accordingly, CRM (M) 2087 of 2026 is dismissed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
