1. Affidavit of service filed in Court today is taken on record.
2. Affidavit of compliance filed on behalf of the contemnor in Court today is also taken on record.
3. Learned advocate representing the contemnor/Corporation submits, upon instructions that, unauthorized construction has been detected at I- 161, Kasai Para Lane, Ward No.135, Borough-XV, PS – Garden Reach and steps have been directed to be taken under Section 400(8) of the Kolkata Municipal Corporation Act, 1980. It has been submitted that steps will be taken for execution of the said order.
4. It appears that order was passed under Section 400(8) on 7th June, 2024. No steps have, however, been taken to execute the said order till date.
5. Prompt necessary steps shall be taken by the authority to execute the order under Section 400(8) of the KMC Act, 1980 without any further delay.
6. The contempt application stands disposed of.
7. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.
8. Certified server copy of this order, if applied for, be supplied to the parties on compliance of all requisite formalities.
