... For the State.
Learned advocate appearing for the petitioner submits that the subject-matter of the present case relates to alleged recovery of 100 bottles of Phensedyl and petitioner is in custody for more than seven months. It has been submitted that recovery was not from the present petitioner and he has been falsely implicated in connection with the instant case; there are no antecedents of the present petitioner also. As such, petitioner prays for bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and produces the case diary. I have taken into account the seizure list which reflects that the same was from an unclaimed destination, the only evidence available relates to the statement of one Sajahan Sk which was recorded on 04.08.2025. Having considered the
2 same and the fact that there was no recovery from the present petitioner and the petitioner has no antecedent and as charge-sheet has already been submitted before the jurisdictional court, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Pintu Sk. @ Jhaitan shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, 3rd Court, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned Special Court and shall not leave the jurisdiction of the district of Malda without prior permission of the learned Special Court. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1273 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
