CRM (NDPS) 1730 of 2026
In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Raninagar Police Station case no. 484 of 2021 dated 20.11.2021 under Sections 21(c)/29 of the NDPS Act.
And In the matter of : Mithu Sekh
……Petitioner. Mr. Tapodip Gupta Mr. Golam Ahammed
......for the Petitioner. Ms. Arushi Rathore Ms. Ananya Chakraborty
……for the State.
Learned advocate appearing for the petitioner submits that there has been alleged recovery of 184 bottles of phensedyl and petitioner is in custody for about 10 months. Learned advocate appearing for the State opposes the prayer for bail as the petitioner was absconding since the year 2021. There are materials according to the prosecution that the petitioner fled away on the contraband being intercepted. The seizure list witnesses have been examined and they support the prosecution case. Having considered the conduct of the present petitioner, at this stage, I am not inclined to release the petitioner on bail. As such, CRM (NDPS) 1730 of 2026 is dismissed. Memo of evidence submitted by the State be kept with the record.
